Senator Hollings Introduces Online Personal Privacy Act

Sen. Fritz Hollings (D-SC), chairman of the Senate Commerce Committee, introduced his long awaited privacy bill on April 18. The bill addresses the collection, use and disclosure of personally identifiable information, requiring notice, opt-in consent for collection and sharing of sensitive personally identifiable information and opt-out for nonsensitive information, as well as security, and consumer access to information. The bill would pre-empt state law regulating Internet privacy, and would provide for a private right of action for persons whose sensitive information has not been treated in accordance with the bill's provisions. A hearing on the legislation is scheduled for April 25, 2002.
